Terms and conditions
1 STANDARD TERMS
1.1 Information on how to enter forms part of the terms and conditions of entry into this promotion and is deemed acceptance by you, of these terms and conditions.
a) Shopping at a Ritchies Supermarket in Victoria, New South Wales or Queensland during the promotional period.
b) And completing the entry form at ritchies.com.au/pickers
2 WHO CAN ENTER ?
2.1 Subject to clause 2.2, entry is open to all Australian residents, 18 years and over.
2.2 Employees and their immediate families of Ritchies Stores Pty Ltd (ABN 31 005 041 814) and also employees and their immediate families of McCain Foods (Aust) Pty Ltd, (96 000 629 587), and their associated agencies and companies, and related bodies corporate are NOT eligible to win.
3 HOW TO ENTER
3.1 The P!ckers consumer promotion commences on Wednesday 24th July at 12.01 am AEST and closes on Tuesday 20 August 2024 at 11.59 pm AEST.
To enter, you are required to purchase any P!ckers product (1 OR MORE) in a single transaction, from the participating P!ckers range, as detailed in Clause 9 at the end of these terms and conditions.
To enter, complete the online entry with your contact information, together with a photo of your receipt for each entry. You have then entered the P!ckers competition and have a chance to share in a prize pool, worth $11,000 value, including Ritchies Gift Cards.
3.2 You can also scan the QR code seen in store, on shelf point of sale, to enter the competition. Participating products will be advertised at each Ritchies store using shelf wobblers in refrigerated & other supermarket shelf locations, on a panel in their catalogues, basket / counter flyers, digital presence with social media and in store TV screens and in E-newsletters.
3.3 Multiple entries are permitted subject to the following:
a) maximum of two entries per day, per eligible transaction, and
b) each entry must be submitted separately and in accordance with entry requirements, and
c) unrecognised receipts will be deemed invalid
3.4 Entrants MUST retain their original purchase receipt (s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested, may in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt (s) must clearly specify the retailer, product purchased, transaction total and that the Eligible Purchase was made during the Purchase period, but prior to entry.
3.5 Winners are drawn at random using a computerised draw.
4 PRIZE WINNERS
4.1 There is one (1) major prize of a $6,000 home theatre system comprising of a Samsung 65" QN85D Neo QLED 4K Smart TV [2024], Sonos Arc Soundbar speaker set with Sonos Sub Woofer Gen 3 and a mini Sonos Road SL portable speaker. The major prize will be drawn at the end of promotion period. Prizes subject to slightly change based on availability. Subject to availability at time, the TV could change model. The total value of the major prize, will remain at up to $6,000 and any difference above this value, will be borne by the winner, with a payment to the organisers of the promotion, before any prize is delivered to the winner. Non redeemable for cash.
4.2 Each weekly draw will include the following prizes:
- Two (2) Ninja AF300 Foodi Dual Zone 7.6L Air Fryers, or similar based on stock availability. There is a total of 8 Air Fryers for the duration of the promotion and the unit has a maximum value of RRP $299.99.
- Seven (7) Ritchies Gift Cards, with a value of $100 each. There is a total of 28x Gift Cards for the duration of the promotion, with a combined value of $2,800.
4.3 Weekly prizes to be drawn at 3.00 pm, at Suite 8/56 Bay Road Sandringham, VIC 3191, by an electronic draw on Thursday 1, 8, 15 and 22 August 2024.
4.4 The final draw for the major prizes will take place at 10.00 am on Friday 23 August 2024, at the above location. All eligible entries, will be included for the main draw.
4.5 Winners will be published on the Ritchies website within 7 days of each draw, www.ritchies.com.au/p!ckers
4.6 Winners will be contacted by phone and email. The winners’ names will also be added to their website within 7 days of the draw at www.ritchies.com.au/pickers
4.7 Prizes will be posted or delivered to the winners, where possible. Alternative arrangements maybe required for some winners depending on their location.
4.8 The winner of the major prize of a home theatre system up to the value of $6,000. The prize winner will be given an option to change the size of the TV and sounds system, based on their personal requirements. The Promoter will not be liable for any additional costs over the total prize amount, as per Clause 4.1.
PRIZE CONDITIONS
a. Prizes cannot be transferred and cannot be redeemed for cash.
b. Additional options and ancillary costs are the responsibility of the major prize winner(s). Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner(s).
c. In accepting the prize, the Winner(s) agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the Winner(s) grants the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use.
d. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
e. Subject to consumer rights under e.g. the Competition and Consumer Act 2010 (Australian Govt.), the Promoter is not liable (including in negligence) for any loss (including indirect or consequential loss or loss of profits), damage, injury or death in connection with this offer or any gift, except liability which can't be excluded (which is limited to the greatest extent allowed by law).
f. Permits are only required in NSW, Australia for this promotion as advised by each State governing body. Permit Authority: TP/03619
5. UNCLAIMED PRIZE DRAWS
5.1 Subject to any written direction any unclaimed prize draw from all non-winning
entries will take place on 20 November 2024 at Suite 8/ 56 Bay Road Sandringham, VIC 3191.
5.2 The Promoter’s decision is final and the promoter will not enter into any correspondence regarding the Competition result.
5.3 It is a condition of accepting any of the prizes that the winners must comply with all conditions of use of the prize and the prize supplier’s requirements.
5.4 It is also a condition of accepting any of the prizes, that the Winners maybe required to sign a legal release in a form determined by the Promoter in its absolute discretion.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders Ritchies Stores Pty Ltd ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, Ritchies Stores Pty Ltd may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
6.2. Ritchies Stores Pty Ltd and their associated agencies and companies, and related
bodies corporate will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail including electronic mail. And further will not be liable for any misadventure, accident, injury, loss or claim that may occur:
a) During the draw;
b) In the participation in any prize;
c) As a consequence of late, lost or misdirected mail, telephone or internet
malfunction;
d) Due to the broadcast of any program relating to the competition or the
publication of any material, including any statements made by any compare,
staff member, journalist, other entrants or any other person;
e) Arising from or related to any problem or technical malfunction of any
telephone network or lines, mobile or internet communications network
related to or resulting from participation in this promotion.
6.3 Ritchies Stores Pty Ltd and their associated agencies and companies, and related bodies corporate assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
6.4 If for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Ritchies Stores Pty Ltd which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, Ritchies Stores Pty Ltd reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
7. GENERAL
7.1 The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.ritchies.com.au/privacy1. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
7.2 The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
